Abstract

This article was made to analyze the reasons (ratio decidendi) decision on the cancellation of the Deed of Sale and Purchase Agreement of land by the judge. Writing this law using non-doctrinal approach or normative research. The results showed that the defendant did not pay the remaining price of the land until the promised time period, the defendant is not good intention to pay off with no immediate sign the deed of sale of land, the act of default by the defendant, the judges indicated their assessment Deed Sale and Purchase Agreement No. 12 dated September 12, 2011 has qualified the validity of an agreement pursuant to Article 1320 of the Civil Code. The court decision stated the defendant to pay compensation of material does not meet the values of justice because they do not pay attention to faith buyer that will pay off through giro and buyers have never enjoyed such land either physically or use this

Abstrak

Artikel ini di buat untuk menanalisis (ratio decidendi) pengambilan keputusan atas pembatalan Akta perjanjian Pengikatan Jual Beli tanah oleh hakim.Penulisan hukum ini menggunakan metode pendekatan non doctrinal atau penelitian normatif. Hasil penelitian menunjukkan bahwa tergugat tidak melunasi sisa harga tanah sampai jangka waktu yang dijanjikan, tergugat tidak beriktikad baik untuk melunasi dengan tidak segera menandatangani akta jual beli tanah, tindakan wanprestasi oleh tergugat, ditandai adanya Penilaian Majelis Hakim Akta Perjanjian Pengikatan Jual Beli No. 12 tanggal 12 September 2011 telah memenuhi syarat sahnya perjanjian sesuai ketentuan Pasal 1320 KUHPerdata. Keputusan hakim yang menyatakan tergugat harus membayar gantirugi materiil kurang memenuhi nilai keadilan karena tidak memperhatikan iktikad pembeli yang akan melunasi lewat bilyet giro serta pembeli belum pernah menikmati tanah tersebut baik menguasai secara fisik maupun menggunakannya.
