Abstract

Land ownership of former certified communal rights in the Province of Papua often lead to dispute, one of which is the conversion of communal land on coutified land. Dispute over foumerly coutified communal land rights are resolved through state administrative courts. The settlement of land disputes over certified communal rights in the state administrative court may end with a verdict of cancellation of a coutifi cate that has been more than 5 years by the judge. Based on the above problem this writing is aimed to find out the status of land certificate of property rights of foumer customary rights the registration of traditional land rights transfer into individual rights, and the reason for the judge to cancel the courtificate. The research method used in this research is empirial juridical method. Technical analysis of data used in this research is a doctrinal approach that is empirial with descriptive analysis method. Based on the results of the research and discussion it can be concluded that the registration of land transitional rights of customary land must be accompanied by customary release, with the transfer of ownership of communal land into private property rights accompanied by the release of customary law community no longer have authority over the former land of coutified. The occurrence of cancellation of the certificate of land over the rights of customary by the judge is due to legal defect in the inssuarance.

Abstrak

Kepemilikan tanah bekas hak ulayat bersertifikat di Provinsi Papua seringkali menimbulkan sengketa, salah satunya peralihan tanah ulayat di atas tanah bersertifikat.Sengketa terhadap tanah bekas hak ulayat bersertifikat diselesaikan melalui Pengadilan Tata Usaha Negara. Penyelesaian sengketa tanah bekas hak ulayat bersertifikat di  Pengadilan Tata Usaha Negara dapat berakhir dengan putusan pembatalan sertifikat yang telah lebih dari 5 tahun oleh hakim. Berdasarkan permasalahan diatas maka penulisan ini bertujuan untuk mengetahui tentangstatus tanah sertifikat hak milik bekas hak ulayat, pengaturan pendaftaran peralihan hak atas tanah ulayat menjadi hak perorangan, serta alasan hakim membatalkan sertifikat.Metode penelitian yang digunakan dalam penelitian ini menggunakan metode yuridis empiris.Teknik analisis data yang digunakan dalam penelitian ini adalah pendekatan doktrinal yang bersifat empiris dengan metode analisis deskriptif.Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa pendaftaran peralihan tanah hak ulayat harus disertai pelepasan adat, dengan beralihnya hak milik tanah ulayat menjadi tanah hak milik perorangan yang disertai pelepasan adat masyarakat hukum adat tidak lagi mempunyai kewenangan terhadap tanah bekas hak ulayat bersertifikat.Terjadinya pembatalan sertifikat atas tanah bekas hak ulayat oleh hakim dikarenakan terdapat cacat hukum di dalam penerbitannya.
