PROBLEMATIKA PERJANJIAN KREDIT PROGRAM KEMITRAAN MENURUT HUKUM PERJANJIAN (Studi di PT. Madubaru, Yogyakarta)

Abstract

This article aims to reviewing the implementation of Corporate Social Responsibility (CSR) and the Partnership and Community Development Program, hereinafter referred to as PKBL at PT. Madubaru, analyzing the problems and solutions. The research method used is descriptive socio-legal research. Types of data that contain primary legal materials obtained directly at the research site and secondary sources sourced from the literature. Data collection techniques, namely interviews and literature study. Data analysis techniques used in this study used qualitative methods with interactive analysis models. Based on the results of the study, it was concluded that the implementation of PK in PT. Madubaru has been approved since 2015 to Sugar Cane Farmers. Implementation of PK in PT. Madubaru also provides coaching that provides grants for 36 months. PT. Madubaru implements the BL Program which is the same as inviting CSR because it encourages charity in creating social and economic development in the community. CSR is implemented by PT. Madubaru because it is closely related to Natural Resources, namely utilizing the land for sugarcane. There is a problem in channeling Partnership Program funds that there is no execution of Collateral in the PK credit agreement and there are no institutions that execute PKBL. Therefore, in creating harmonization between Micro and Small Enterprises (MSEs) in Indonesia with companies, the solution offered to overcome the problems are insurance for protection and donor agencies controlling the Non-Bank Financial Industry as a result of the Partnership Program credit assistance.
