Abstract

This article aims to review the legal protection of the characteristic of traditional cultural expressions based on Law Number 28 of 2014 concerning copyright. This legal research uses the normative/doctrinal method. This research is prescriptive with the type of research data that is studying literature and secondary data both primary and secondary legal materials. Protection of Traditional Cultural Expressions by the Copyright Act has not been maximized due to problems related to several conditions stipulated in the Copyright Act including 'fixation work', 'originality', 'identifiable creator' and limited time period. The requirement for a ‘form of tangible work’ (fixation) in copyright law is one of the requirements that must be met if a 'work' is entitled to legal protection. In this study it was found that the copyright legal system is difficult to provide protection for traditional Cultural Expressions because to fulfill the concept of creation protected, Traditional Cultural Expressions must be original and realized in a media, the element of authenticity and embodiment is difficult to fulfill, besides that the protection of economic rights against Expression Traditional Culture is also difficult to fulfill, due to the nature of traditional society which is open and ignores the economic rights of Traditional Cultural Expressions.

Abstrak

Artikel ini mengkaji mengenai perlindungan hukum karakteristik ekspresi budaya tradisional berdasarkan Undang – Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Penelitian hukum ini menggunakan metode normatif/doktrinal. Penelitian ini bersifat preskriptif dengan jenis data penelitian yaitu mengkaji bahan pustaka dan data sekunder baik bahan hukum primer maupun bahan hukum sekunder. Perlindungan Ekspresi Budaya Tradisional oleh UU Hak Cipta belum maksimal dikarenakan adanya permasalahan terkait dengan beberapa syarat yang diatur dalam UU Hak Cipta di antaranya mengenai ‘bentuk karya berwujud’ (fixation work), ‘keaslian’ (originality), ‘pencipta teridentifikasi’ (identication of author) dan jangka waktu yang dibatasi. Persyaratan bentuk karya berwujud (fixation) dalam hukum cipta merupakan salah satu peryaratan yang harus dipenuhi bilamana suatu ‘karya’ berhak untuk mendapatkan perlindungan hukum. Dalam penelitian ini ditemukan bahwa sistem hukum hak cipta sulit untuk memberikan perlindungan ekspresi budaya tradisional dikarenakan untuk memenuhi konsep ciptaan yang dilindungi, ekspresi budaya tradisional harus memenuhi syarat asli dan diwujudkan dalam suatu media, unsur keaslian dan perwujudan ini sulit untuk dipenuhi, selain itu perlindungan hak ekonomi terhadap ekspresi budaya tradisional juga sulit dipenuhi, dikarenakan sifat masyarakat tradisional yang terbuka dan mengabaikan hak ekonomi dari ekspresi budaya tradisional.
