PENERAPAN TEORI EFISIENSI DALAM PEDEKATAN RULE OF REASON PADA PEMBUKTIAN KASUS PERSAINGAN USAHA TIDAK SEHAT

Abstract
This article aims to determine the application of efficiency theory in the approach of rule of reason on the verification of unfair business competition case. This research is a normative research viewed from prespective and technical/applied. The approach is using statute approach. This research is using primary legal materials and secondary legal materials. The legal materials collected through library research and study of the document which is analyzed using a technique based on the method of deductive. The application of efficiency theory in the approach of rule of reason to prove the verification of unfair business competition is the way of business competition law enforcers in understanding how business actors in choosing the best alternative to meet their needs. The application of efficiency theory aims to create healthy business competition.

Abstrak
Artikel ini bertujuan untuk mengetahui penerapan teori efisiensi dalam pendekatan rule of reason pada pembuktian kasus persaingan usaha tidak sehat. Penelitian ini merupakan penelitian hukum normatif yang bersifat preskriptif dan teknis/terapan. Pendekatan penelitian menggunakan pendekatan Undang-Undang. Bahan hukum penelitian ini  menggunakan bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan bahan hukum melalui studi kepustakaan atau studi dokumen (library research), yang selanjutnya dianalisis dengan menggunakan teknik deduksi. Penerapan teori efisiensi dalam pendekatan rule of reason pada pembuktian kasus persaingan usaha tidak sehat adalah cara para penegak hukum persaingan usaha dalam memahami bagaimana para pelaku usaha dalam memilih alternatif yang terbaik untuk memenuhi kebutuhan mereka. Penerapan teori efisiensi ini bertujuan untuk membantu terwujudnya ilkim persaingan usaha yang sehat.
