Abstract

This article aims to examine the legal issues in the implementation of online sale and purchase agreements through social media by clothing traders at Beteng Trade Center Surakarta and solutions to problems in implementing online sale and purchase agreements through social media. This research is a descriptive empirical law research, using secondary data types in the form of primary legal materials and secondary legal materials. Data collection techniques by interview and literature study. The analysis technique is deductive with the syllogism method. Law problems that arise in the form of violations of the law, online sale and purchase agreements through social media made by clothing traders at Beteng Trade Center Surakarta with consumers too simple, low consumer protection, weak law enforcement in handling cases in the implementation of online sale and purchase agreements. The solution to the problems in the implementation of the online purchase agreement is in the form of preventive, repressive and curative measures.

 Abstrak

Artikel ini bertujuan mengkaji permasalahan hukum dalam pelaksanaan perjanjian jual beli online melalui media sosial oleh pedagang pakaian di Beteng Trade Center Surakarta dan solusi atas permasalahan dalam pelaksanaan perjanjian jual beli online melalui media sosial. Penelitian ini adalah penelitian hukum empiris bersifat deskriptif, menggunakan jenis data sekunder berupa bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data secara wawancara dan studi kepustakaan. Teknik analisis bersifat deduktif dengan metode silogisme. Permasalahan hukum yang timbul yaitu berupa terjadinya pelanggaran hukum, perjanjian jual beli online melalui media sosial yang dibuat oleh pedagang pakaian di Beteng Trade Center Surakarta dengan konsumen terlalu sederhana, rendahnya perlindungan konsumen, lemahnya penegakan hukum dalam menangani kasus dalam pelaksanaan perjanjian jual beli online. Solusi atas permasalahan dalam pelaksanaan perjanjian Jual Beli online tersebut yaitu berupa tindakan preventif, represif dan kuratif.
