Abstract

This article aims to determine the legal requirements for E-Commerce contract on the Blibli.com and to find out whether the principle of justice is contained in E-Commerce contract conducted through the Blibli.com site. This type of research is normative legal research. The legal sources used consist of primary legal materials, secondary legal materials, and tertiary legal materials. The results of this legal research show that the legal requirements for E-Commerce contract are regulated in Article 1320 of the Civil Code, Article 3, Article 9, Article 15 paragraph (1), Article 17, and Chapter III of the Information and Electronic Transaction Law, Articles 45 to Article 50 Government Regulations for the Implementation of Electronic Systems and Transactions, and Article 18 of the Consumer Protection Act and related E-Commerce contract on the Blibli.com site have not fully complied with the principle of contractual justice because the rights and obligations of the users and parties have not been fulfilled. Blibli.com. Regarding the principle of justice on the Blibli.com site, the principle of contracting justice has not yet been fulfilled. Because there is an unbalanced portion between Users and Blibli.com itself.

 Abstrak

Artikel ini bertujuan untuk mengetahui syarat sahnya kontrak jual beli online dalam situs Blibli.com dan untuk mengetahui apakah asas keadilan sudah terdapat dalam kontrak jual beli online yang dilakukan melalui situs Blibli.com. Metode penelitian ini adalah penelitian hukum normative dan sumber hukum yang digunakan terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier dengan cara studi pustaka. Hasil penelitian hukum ini menunjukkan bahwa syarat sahnya kontrak jual beli online diatur di dalam Pasal 1320 KUH Perdata, Pasal 3, Pasal 9, Pasal 15 ayat (1), Pasal 17, dan Bab III Undang-undang Informasi dan Transaksi Elektronik, Pasal 45 sampai Pasal 50 Peraturan Pemerintah Penyelenggaraan Sistem dan Transaksi Elektronik, dan Pasal 18 Undang-undang Perlindungan Konsumen serta terkait kontrak jual beli online pada situs Blibli.com belum sepenuhnya memenuhi asas keadilan berkontrak dikarenakan belum terpenuhinya kesetaraan hak dan kewajiban yang dimiliki dan dijalankan antara Pengguna dengan pihak Blibli.com. Mengenai asas keadilan pada situs Blibli.com ternyata belum terpenuhi asas keadilan berkontrak tersebut. Dikarenakan terdapat porsi tidak seimbang antara Pengguna dengan Blibli.com itu sendiri.
