TANGGUNG JAWAB PIHAK BANK DALAM PERJANJIAN SEWA MENYEWA SAFE DEPOSIT BOX YANG DIDUGA DIDALAMNYA TERKANDUNG KLAUSULA EKSONERASI (Studi di PT. Bank Panin Surakarta)

Abstract
The purpose of this article is to find out the responsibility of the bank in the Safe Deposit Box lease agreement as well as whether there is an exoneration clause in the agreement. Safe Deposit Box is a storage box for specially designed items of steel material and placed in a sturdy and fire-proof place to keep the goods safe and provide a sense of security for the goods it stores. Generally the items stored in the Safe Deposit Box have a high material value and are very important for Safe Deposit Box customers. The objective of the community for storage is for the security of the possibilities of fire, theft, robbery and other matters that may threaten the security of documents or valuables they possess. Regarding the duty of the bank in providing Safe Deposit Box is stipulated in Act Number 10 of 1998 concerning Banking article 6 (item h) which contains about providing a place to store goods or securities.

Abstrak
Tujuan artikel ini adalah untuk mengetahui tanggung jawab bank dalam perjanjian sewa menyewa Safe Deposit Box serta apakah benar adanya klausula eksonerasi dalam perjanjian tersebut. Safe Deposit Box  adalah  sebuah  kotak  penyimpanan  untuk  barang  yang  dirancang  khusus  dari  bahan  baja  dan ditempatkan di tempat yang kokoh dan tahan api untuk menjaga keamanan barang dan memberikan rasa aman untuk barang yang disimpannya. Umumnya barang yang tersimpan dalam Safe Deposit Box memiliki nilai material yang tinggi dan sangat penting bagi nasabah Safe Deposit Box.  Tujuan masyarakat melakukan penyimpanan adalah demi keamanan dari kemungkinan-kemungkinan kebakaran, pencurian, perampokan dan hal-hal lain yang dapat mengancam keamanan dokumen atau barang berharga yang mereka miliki. Mengenai tugas bank dalam menyediakan Safe Deposit Box diatur dalam Undang-undang Nomor 10 Tahun 1998 tentang Perbankan pasal 6 (butir h) yang berisi tentang menyediakan tempat untuk menyimpan barang atau surat berharga.
