PENERAPAN ASAS KEADILAN DALAM TRANSAKSI JUAL BELI ONLINE (Studi di Lazada)

Abstract
The purpose of this article to determine whether agreement in electronic transactions through Lazada site meet the principle of justice. This legal research method used in this legal writing include: normative type of research, descriptive nature of research, types and sources of data for this research include primary data is obtained from the legislation, and secondary data obtained from books and scientific publications related this research.. Based on research and analysis of data, the agreement in electronic transaction through Lazada site not according with the principle of justice, which is principle of justice based on principle of freedom of contract, and principle of proportionality.

Abstrak
Artikel ini bertujuan untuk mengetahui asas keadilan dalam perjanjian jual beli online melalui situs Lazada. Penulisan ini menggunakan metode penelitian normatif yang bersifat deskriptif, Sumber bahan hukum menggunakan bahan hukum primer berupa peraturan perundang- undangan dan bahan hukum sekunder berupa buku-buku dan semua publikasi ilmiah tentang penelitian hukum terkait. Teknik pengumpulan data menggunakan studi pustaka baik dari media cetak maupun media elektronik (internet). Berdasarkan hasil penelitian dan analisis data, perjanjian jual beli online melalui situs Lazada belum sepenuhnya memenuhi asas keadilan, yang mana asas keadilan ini dilihat dari asas kebebasan berkontrak dan asas proporsionalitas.
