KEADILAN BERKONTRAK DALAM REFORMULASI HUKUM INFORMED CONSENT BERBASIS KEADILAN SOSIAL

Abstract

This paper discusses necessary contracted justice on informed consent reformulation based on social justice in physician and patient relationships. The necessary begins from the absence of justice for physician and patient in the actualization of Informed Consent. Relevant legislation is not based on justice. This paper is a presciptive legal research with approach of law and conceptual approach. The technique of collecting legal materials in this paper is literature study. The technique of analysis of legal materials used is the method of deduction. This paper concludes a review of Law No. 29 of 2004 on Medical Practice to accommodate the contracted justice in Informed Consent based on social justice. This paper recommended Article 2 of the a quo law the formula is changed to be"Medical Practice is based on the principle of (i) Social Justice; (Ii) Equality; (Iii) Utilization; (Iv) Humanity; And (v) Protection and patient safety."

Abstrak

Tulisan ini membahas kebutuhan keadilan berkontrak dalam reformulasi hukum Informed Consent berbasis keadilan sosial. Kebutuhan beranjak dari absennya keadilan bagi dokter dan pasien pada pemberian informasi dan persetujuan Informed Consent. Peraturan perundang-undangan yang relevan belum berpijak kepada keadilan tersebut. Penelitian ini merupakan penelitian hukum yang bersifat preskiptif dengan pendekatan undang-undang dan pendekatan konseptual. Teknik pengumpulan bahan hukum studi pustaka dan teknik analisis bahan hukum metode deduksi. Hasil tulisan ini menyimpulkan diperlukan peninjauan Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran untuk mengakomodir gagasan keadilan berkontrak dalam reformulasi hukum Informed Consent berbasis keadilan sosial. Tulisan ini merekomendasikan perubahan Pasal 2 undang-undang a quo yang rumusannya diubah menjadi “Praktik kedokteran didasarkan pada asas (i) Keadilan Sosial; (ii) Kesetaraan; (iii) Kemanfaatan; (iv) Kemanusiaan; dan (v) Perlindungan dan keselamatan pasien.”
