Optimalisasi Peran Mediator Dinas Tenaga Kerja Kabupaten Karanganyar Dalam Melindungi Hak-Hak Pekerja Akibat Pemutusan Hubungan Kerja

Abstract

This research examines the role of the Karanganyar Regency Manpower Office mediator in protecting workers' rights due to layoff. The main objective of the research is to explore the role of the mediator in resolving disputes between workers and employers, as well as analyzing the factors that hinder the effectiveness of the mediator in carrying out its duties. The research method used is empirical law with a qualitative approach, using primary data obtained directly from the Regency Manpower Office mediator and secondary data in the form of laws and regulations and related literature. The results of the research indicate that the role of the Karanganyar Regency Manpower Office mediator in assisting and protecting workers’ rights due to layoff is not optimal. It can be seen from the resolution of industrial relations disturbances that reached a collective agreement was 357 cases and for the resolution of disturbances that reached a written agreement was 745 cases. The inhibiting factors of the Manpower Office mediator in resolving obstacles are the difficulty in getting employers to attend mediation meetings, falsification of negotiation minutes by workers, and the company's bankruptcy filing process is taking a long time.
