FUNGSI HUKUM SEBAGAI ALAT DAN CERMIN PERUBAHAN MASYARAKAT

Abstract

Initially the law is constructed as the control tool for its society, particularly when other social control mechanisms cannot work well. Law as one of social system work sets should be able to accommodate the needs and interests as well as should be able to give the fair service for its society. The law should be able to integrate all interests and resources existing in the society, so that the orderliness, security and social order can be created in the society life.

In its development, law is currently not only constructed as the social control instrument, but the law should also be constructed as a tool of social engineering, the social change occurring in structured manner in the form of structured and systematic society changes is the form of society development.

The role of law in development can be said as an instrument of ensuring that the social change occurring will run regularly. The regular social change through the law procedure, in the form of both legislation and judicature agencies’ decision will be better than the irregular change.
