URGENSI PERLINDUNGAN HUKUM BAGI KORBAN PORNOGRAFI BALAS DENDAM (REVENGE PORN)

Penelitian ini bertujuan untuk mengkaji ketentuan hukum mengenai perlindungan terhadap korban kejahatan revenge porn yang semakin marak terjadi di realita masyarakat. Penelitian ini menerapkan metode normatif yang bersifat preskriptif dengan menggunakan dua pendekatan, yakni pendekatan futuristis dan pendekatan deskripsi. Hasil penelitian menunjukan bahwa pada kondisi saat ini, masih belum terdapat payung hukum yang dapat memberikan perlindungan secara khusus terhadap korban revenge porn. Korban kejahatan seksual, termasuk tindakan penyebaran konten pornografi atas dasar balas dendam dalam kasus ini memerlukan perhatian khusus. Minimnya perlindungan hukum bagi korban serta terdapat beberapa ketentuan pasal dalam Undang-Undang Pornografi dan Undang-Undang Informasi dan Transaksi Elektronik yang dinilai rawan akan adanya kriminalisasi bagi korban, mengakibatkan banyaknya korban revenge porn yang enggan melaporkan atas kerugian yang dialaminya. Oleh karena itu, perlu dilakukan pembaharuan hukum pidana terkait perlindungan yang secara khusus diperlukan bagi korban revenge porn maupun kekerasan seksual berbasis gender siber lainnya.

Abstract

This research aims to examine the legal provisions regarding to the protection of revenge porn crime victims which is increasingly happening in the reality of society. This study applies a prescriptive normative method using two approaches, namely the futuristic approach and the descriptive approach. The results of the study indicate that under current conditions, there is still no legal regulation that can provide special protection for victims of revenge porn. Victims of sexual crimes, including acts of distributing pornographic content on the basis of revenge in this case require special attention.The lack of legal protection for victims and there are several provisions of articles in the Pornography Law and the Information and Electronic Transactions Law which are considered prone to criminalization for victims, resulting in many victims of revenge porn who are reluctant to report their cases. Therefore, it is necessary to reform the criminal law related to the protection that is specifically needed for victims of revenge porn and other cyber gender-based sexual violence.
