PENGATURAN APLIKASI YANG BERMUATAN MELANGGAR KESUSILAAN DI INDONESIA

Tujuan dari penelitian ini adalah untuk membandingkan pengaturan dari dua undang-undang yaitu Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik dengan revisi kedua  Undang-Undang Nomor 19 Tahun 2016 Revisi Undang-Undang Nomor 11 Tahun 2008 Dengan Undang-Undang Nomor 44 Tentang Pornografi terhadap aplikasi yang memiliki muatan atau konten yang melanggar kesusilaan. Penelitian hukum ini merupakan hukum normatif dalam bentuk studi kasus dengan menggunakan data sekunder yaitu data yang diperoleh dari buku, literatur dan undang-undang yang terkait dalam penelitian ini yaitu Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik dengan revisi kedua Undang-Undang Nomor 19 Tahun 2016 dan Undang-Undang Nomor 44 Tentang Pornografi. Hasil penelitian menunjukkan adanya perbedaan pengaturan dari kedua undang-undang tersebut, perbedaan tersebut terdapat pada pengaturan unsur melanggar kesusilaan itu sendiri. Namun masih timbul permasalahan hukum walaupun sudah terdapat kedua undang undang tersebut yaitu adanya penyalahgunaan aplikasi yang mengandung unsur kesusilaan seperti cyberseks.

Abstract

This aim of the research is to compared the arrangement from two laws, the Laws is Law Number 11 Year 2008 about Information and Electronic Transactions J.O Law Number 19 Year 2016 Revision of Law Number 11 Year 2008 by Act Number 44 About Pornography on an application that has the content or the content has violates decency. This act research is normative law in the case studies with using of secondary data, the secondary data are data from the books, literature, and laws related in this study are Law Number 11 Year 2008 about Information and Electronic Transactions J.O Law Number 19 Year 2016 Revision of Law Number 11 Year 2008 by Act Number 44 About Pornography. The results of the research show the difference in the settings of both these laws, the difference are from the settings of the elements of violates decency itself. But, there are still problems arise the law although there are already two laws, the abuse of the application that containing the elements of violates decency such as cybersex.
