TINDAK PIDANA PENYEBARAN KEBENCIAN ATAU PERMUSUHAN MELALUI DUNIA MAYA (Analisis Putusan Hakim Pengadilan Negeri Pati Nomor: 10/Pid.Sus/2013/PN.Pt)

Penelitian ini bertujuan untuk mengetahui analisis putusan hakim terhadap tindak pidana menyebarkan kebencian atau permusuhan melalui media sosial (facebook) dan penerapannya melalui pertimbangan hakim dalam putusan Pengadilan Negeri Pati Nomor : 10/Pid.Sus/2013/PN.Pt. Penelitian ini menggunakan metode penelitian hukum normatif atau penelitian hukum doktrinal yang bersifat preskriptif atau terapan. Penelitian ini menggunakan sumber bahan hukum primer dan sekunder. Teknik analisis yang digunakan yaitu dengan metode silogisme yang menggunakan pola berpikir deduktif. Pola berpikir deduktif merupakan cara berpikir pada prinsip-prinsip dasar, kemudian penelitian menghadirkan objek yang akan diteliti guna menarik kesimpulan terhadap fakta-fakta yang bersifat khusus. Berdasarkan hasil penelitian dapat disimpulkan bahwa pertimbangan hakim dalam menerapkan putusan Pengadilan Negeri Pati dalam Putusan Nomor: 10/Pid.Sus/2013/PN.Pt sudah sesuai dengan hukum positif yang berlaku di Indonesia. Pertimbangan Majelis Hakim adalah karena didalam diri terdakwa tidak terdapat alasan-alasan yang dapat menghapus pidana Terdakwa, baik alasan pemaaf maupun alasan pembenar.Pidana yang dijatuhkan hakim ternyata lebih ringan yaitu 4 (empat) tahun penjara dikurangi masa tahanan dibanding dengan ancaman pidana selama 6 (enam) tahun penjara. Ini dikarenakan Terdakwa belum pernah dihukum dan Terdakwa berusia relatif masih muda diharap dapat memperbaiki kelakuannya.

Abstract

This study aims to determine the analysis verdict against the crime of spreading hatred or hostility through social media ( facebook ) and its application through the consideration of the judge in the District Court Pati Number : 10 / Pid.Sus / 2013 / PN.Pt. This study uses normative legal research or legal research doctrinal prescriptive or applied. This study uses a source of primary and secondary legal materials. The analysis technique used is the syllogism method that uses deductive reasoning patterns. The pattern of deductive reasoning is a way of thinking on the basic principles, and then present the research object to be examined in order to draw conclusions on the facts that are special. Based on the results of this study concluded that consideration of the judge in applying Pati District Court in Decision No. 10 / Pid.Sus / 2013 / PN.Pt are in accordance with the applicable positive law in Indonesia. Consideration of the judges is because in self-defendant there are no reasons to remove criminal defendant, either an excuse or justification. Sentence imposed judges turned out to be lighter which is 4 (four) years in prison minus time served rather than to a penalty of six (6) years in prison. This is because the defendant and the defendant has not been convicted of relatively young age is expected can improve his behavior.
