STUDI PERBANDINGAN HUKUM LEGALITAS PERJUDIAN DI INDONESIA DAN FILIPINA

Abstract

Setiap negara memiliki pendekatan yang berbeda dalam mengatur perjudian. Penelitian ini bertujuan untuk membandingkan regulasi perjudian di Indonesia dan Filipina guna memahami pola pengaturan yang diterapkan di kedua negara tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perbandingan hukum. Hasil penelitian menunjukkan bahwa di Indonesia, perjudian sepenuhnya ilegal dan dikategorikan sebagai tindak pidana. Sementara itu, di Filipina perjudian berbasis darat adalah legal selama memiliki lisensi resmi dari otoritas yang berwenang, sedangkan perjudian online, mulai 01 Januari 2025 dinyatakan ilegal.

Abstract:Every country adopts a distinct approach to gambling regulation. This study seeks to analyze and compare the legal frameworks governing gambling in Indonesia and the Philippines to identify the regulatory models applied in each jurisdiction. Utilizing a normative juridical method with a comparative law approach, the research findings reveal that gambling is entirely prohibited and criminalized in Indonesia. In contrast, in the Philippines, land-based gambling is legal, provided it is licensed by the relevant authorities, whereas online gambling is permitted only for foreign nationals and licensed entities, but remains illegal for Filipino citizens. However, effective January 1, 2025, online gambling will be completely prohibited in the Philippines.
