The role of international norm-making and the application of international law norms in the international legal subjectivity of international non-governmental organizations

Abstract


This work implies to analyze the current state of INGOs as subjects of international law and lawmaking, as well as to determine the existing problems of their international legal institutionalization and development prospects. Certain aspects of this work on the research issue cover the experience of Azerbaijan. The study examines various contemporary approaches to defining the subjectivity of INGOs and the main elements of their international legal subjectivity. Besides, within the frames of the work there was cosidered the role of international NGOs in the international norm-setting process and the participation of INGOs in the application of international legal norms. The results of the study indicate that at the current stage, INGOs are not subjects of international law in the formal international-legal understanding, but are important subjects of international relations and dynamically developing institutions. At the same time, taking into account the current role of INGOs in the sphere of international activity and their significant operational coverage, there is a need to adopt an international normative act in this area. International formalization of the status and powers of INGOs will close a number of legal gaps, creating the basis for the implementation of relevant norms in national legislation.
