Analisis Yuridis Putusan Pidana Pembinaan Terhadap Anak Pelaku Pencurian Dengan Pemberatan

Abstract

       The aim of this research are to know criminal proceeding of children defendant based on Law Number 11 of 2012 about Child Judicature System which applying Restorative Justice with involving the societies. This research is normative juridical by analyzing case law. The collected data were analyzed using document research technique. The analyzing technique were using syllogism. Based on analysis result there was concluded that the criminal proceeding already applying Restorative Justice with involved of societies. Also when brought to justice, the Judges already based on juridical and non-juridical consideration.
