ASAS KEPASTIAN HUKUM DAN KEADILAN DALAM EKSEKUSI JAMINAN HAK TANGGUNGAN BERUPA SERTIPIKAT ELEKTRONIK
Abstract
Digital transformation in the field of land through the issuance of electronic certificates has legal implications for the execution of mortgage rights. This study aims to analyze the legal position of electronic certificates in the mortgage system and assess the fulfillment of the principles of legal certainty and justice in their execution. This study is a normative legal study with a regulatory and conceptual approach. The legal materials used include Law Number 4 of 1996 concerning Mortgage Rights, the Electronic Information and Transaction Law, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 3 of 2023 concerning the Issuance of Electronic Documents in Land Registration Activities. The results of the study show that electronic certificates have the same legal status and evidentiary value as conventional certificates as long as they are issued through a reliable and valid electronic system. However, in the practice of executing mortgage rights, there are still challenges related to infrastructure readiness, mechanisms of evidence in court, and the understanding of law enforcement officials, which have the potential to affect legal certainty and a sense of justice for the parties. Therefore, it is necessary to strengthen technical regulations and harmonize the application of electronic certificates in the process of executing mortgage rights.
