ANALISIS TERHADAP MEKANISME PENYELESAIAN KONFLIK INTERNAL PARTAI POLITIK DITINJAU DARI PRINSIP DEMOKRASI

Abstract

This study describes and examines the problems regarding internal conflict political parties and the settlement in  Law Number 2 of 2011 Jo Act Number 2 of 2008 on Political Parties and finding an ideal formulation on the mechanisms conducted by political parties in the settlement internal party conflict based of the principles of democracy.

This  research is a normative legal research which is prescriptive. This legal research is using statute approach, case approach, comparative approach, and the concept approach. The research materials used in this legal research is primary legal materials and secondary legal materials. Technique of collecting data used was document study and to complete the data do the retrieval of information by interviews. Technique of anayzing data used in thes research was syllogism method with deductive thinking pattern.

Internal dispute resolution mechanisme of political parties in Indonesia has not been effective to achive the good institutionalization of the party and accordance with denocratic principles. Political parties are not able to settle the conflict and do management conflict of internal conflict in the party. Internal conflict of political parties such as dualism management on structural party, the sacking members without valid reasons, a violation of the constitution party, and the implementation of local elections. Such failure may be due to several factors such as the ineffectiveness of Court Political Parties , the intervention of the Executive to the internal party conflict, the settlement through the courts is  drawn into political problems. For that reason, an ideal formulation was required to settle the internal party conflicts based on democratic prinsiples. So the political parties will be institutionalized and able to performs the functions properly.
