Proses Pengambilan Keputusan Pada Pengelolaan dan Pendistribusian Lahan Oleh Badan Bank Tanah: Sebuah Tinjauan Hukum

Abstract

Penelitian ini mengeksplorasi proses pengambilan keputusan oleh badan bank tanah. Setiap tindakan yang dilakukan pada dasarnya mengacu pada keputusan yang telah ditetapkan. Keputusan memiliki urgensi tinggi ketika ia digunakan sebagai dasar pengelolaan dan pendistribusian lahan yang dapat mempengaruhi kondisi sosio-ekonomi masyarakat secara langsung. Dengan menggunakan penelitian hukum yang menelaah Undang-Undang dan dilengkapi hasil wawancara terdapat beberapa hasil, seperti: pengambilan keputusan dapat menjadi master plan yang menjadi dasar orientasi pengelolaan dan pendistribusian lahan; terdapat kekosongan hukum pada pengambilan keputusan pada pengelolaan dan pendistribusian lahan yang berimplikasi pada inkonsistensi tindakan dan bergantung pada etika personil badan bank tanah. Namun demikian, artificial intelligence berpotensi mengoptimalkan, mengefektifkan, dan mengefisiensikan proses pengambil keputusan. Lain sisi, hukum yang menjadi standarisasi penggunaan teknologi masih belum dilegalisasi. Pembuatan hukum harus dilakukan untuk menciptakan keputusan pengelolaan dan pendistribusian lahan berkeadilan, konsisten, dan luarannya terukur.
