HUKUM ADALAH DISIPLIN ILMU SUI GENERIS : KAJIAN PERSPEKTIF FILSAFAT ILMU

Abstract

Legal science is a science that has a material object of the norm, in the perspective of philosophy of science, yet the science of law (which is more accurately called jurisprudence) is a discipline that sui generis is the science of law is the science of its own kind, because it has a distinctive character that is reflected in the nature normative. In the science of law sui generis character is used to show that in the science of law should never be forgotten or overruled its normative character, ie on the one hand the science of law has an analytical empirical nature, but on the other hand as a practical science normative. With all the scientific attributes attached to it, the science of law directs its reflection on solving concrete problems and the natural potential of society.

Ilmu hukum merupakan ilmu yang memiliki objek material norma, dalam perspektif filsafat ilmu, namun demikian ilmu hukum (yang lebih tepat disebut jurisprudence) merupakan disiplin ilmu yang bersifat sui generis yaitu ilmu hukum merupakan ilmu jenis sendiri, karena memiliki karakter yang khas yang direfleksikan dalam sifat normatifnya. Dalam ilmu hukum karakter sui generis digunakan untuk menunjukkan bahwa dalam ilmu hukum jangan pernah dilupakan atau dikesampingkan karakter normatifnya, yakni pada satu sisi ilmu hukum memiliki sifat empiris analitis, namun di sisi lain sebagai ilmu praktis normatif. Dengan segala atribut ilmiah yang melekat padanya, ilmu hukum mengarahkan refleksinya pada pemecahan masalah-masalah konkret dan potensial alam masyarakat.
