Tantangan Hukum dalam Pengaturan Jaminan Keselamatan Pasien Home Care Digital bagi Lansia dan Penderita Penyakit Kronis
Abstract
The concept of home healthcare through digital home care services represents a strategic innovation in the development of the Indonesian healthcare system. This service offers an effective solution to improve the comfort and continuity of care for elderly patients and patients with chronic diseases, a vulnerable group. However, the integration of digital technology into clinical practice in healthcare services raises legal challenges, particularly regarding the regulation of patient safety guarantees. This study aims to analyze the legal challenges that govern the mechanisms of accountability and risk prevention in the patient safety aspects of Digital Home Care for the elderly and patients with chronic diseases in Indonesia, with a focus on legal protection. The method used is a deductive and interpretive legal approach through a normative analysis of laws and regulations, relevant literature, and several case studies. The results show that most patient safety targets in Digital healthcare services have been optimally implemented, but several aspects require improvement. There are not always clearly stated standard requirements, and the patient care process, especially in emergency cases, cannot always be directly monitored. Deficiencies in patient protection in digital services, such as the potential for data leakage, reflect the complexity of legal protection for patients, particularly the elderly and patients with chronic diseases. Therefore, regulatory need to updates which responsive to technological developments, as well as strengthening oversight mechanisms and legal accountability of service providers, are needed. This research is expected to provide a real contribution in encouraging the formation of adaptive and comprehensive legal policies to protect vulnerable patient groups in the digital era, especially in the context of digital home care services.
